This seminar was arranged by Lexis Nexis and presented by Brink Cohen & le Roux Attorneys 3 June 2010 at Emperor’s Palace.

The amazing result was the well thought through arguments developed by Industry, as aligned with the current Health & Safety crises experienced in the United Kingdom.

What were so amazing were not the arguments itself, but that these arguments were “ahead” of those utilized by the same industry in the developed world.

Therefore, South African Mine Industry is ahead of the world in terms of its Safety approach.

From an occupational point of view, South African mines causes less than 0.4% of fatalities through external causes yearly reported. This despite South Africa being a country with a risk appetite 10 times that of its developed world competitors.

Also, South African mine statistics are better than its “2nd world partners” such as Brazil, Russia, India and China.

The stroke of genius came when safety statistics were proven to be within the limits of the reasonable man – as the law suggests it should be.

It does seem at this point, that Industry does not need a regulator. Maybe the British are looking for a replacement, no?
